Arbitration / Union Member Job Bid

Rohm and Haas sold a division to RohMax.  Rohm and Haas employees were transferred to RohMax pursuant to a letter of agreement negotiated by USW13-1. The Letter of Agreement provided for "employees" to have a life time bid back option to Rohm and Haas.  Although the grievant was not a member of the union at the time of the Letter of Agreement, BN successfully persuaded the arbitrator to apply the bid rights provision to the non-Union member and order his bid to be accepted and full back pay.


Electric Power Company / Amputation

A nine (9) year old child suffered a right arm below the elbow amputation as a result of contact with a Texas New Mexico Power line that was allowed to run through the middle of trees in violation of regulatory standards. Suit was brought in Galveston County District Court. In less than a year from filing the lawsuit, a confidential settlement was entered with the power company. As a part of the settlement, the power company agreed to use Plaintiff's model of the incident as a part of a public awareness campaign in elementary schools.


Texas Tort Claims Act / Special Defect

Two Liberty High School students were involved in a motor vehicle collision resulting in one death and severe brain injuries to the other child. A claim was made against the Texas Department of Transportation for a special defect in the highway. After a trial and $19.1 million verdict, the case settled during hearings for entry of judgment.


Toxic Tort / Brio Superfund Site

Ninety (90) minors were represented for various injuries resulting from the Brio Superfund Site including one child who died from leukemia. The case settled the weekend before trial was to begin in Harris County District Court.


Toxic Tort / Motco Superfund Site

The children and grandchildren of a family that resided on what was later the Motco Superfund Site brought claims for severe birth defects in Galveston County Court at Law No. 2. The confidential settlement resolved the cases for the last residents of this superfund site.


ERISA / Employee Stock Plan

Over three hundred fifty (350) workers from Amoco Texas City brought claims in the United States District Court for the Southern District of Texas, Galveston Division against Amoco and State Street Bank - Boston when they were "locked out" from trading for over ten (10) days. During this time frame, there was a significant increase in the stock price. A confidential settlement was reached which included the implementation of backup systems to prevent the same situation from occurring in the future.


Failed Real Estate Transaction & Breach of Fiduciary Duty / Negligence

A Taiwanese business man entered a contract with the City of Texas City to build a theme park on the Texas City Dike. A condition precedent involved a wire transfer to be handled by Moody National Bank and escrowed with Stewart Title. The wire transfer was "lost' and resulted in the business deal failing. Claims were made against Moody National Bank and Stewart Title in Galveston County District Court which resulted in a verdict in favor of our client.


Employee Stock Options / Breach of Contract

When MFS was taken over by WorldCom, an employee was denied his stock options. A lawsuit was filed in the United States District Court for the Southern District of Texas, Galveston Division. Within three (3) months of filing suit, the case was settled for the exercise of the original stock options at the value of the stock at the time of settlement, which had substantially increased due to the takeover by WorldCom.


Offshore Oil Technology / Patent Infringement

A professor from the University of Tel Aviv patented a mathematical formula to eliminate "ghosts" in hydrophone readings. Suit was filed in the United States District Court for the Southern District of Texas, Houston Division. After two (2) days of mediation, the case settled for a confidential amount.


Americans with Disabilities Act

A rubber plant worker in Port Arthur , Texas was terminated when he injured his knee at work and could no longer perform his old job. The firm recovered a $930,000.00 jury verdict in Federal Court in Beaumont , which was at that time the largest Americans with Disabilities Act verdict in the country. The judgment, which was not appealed, was later entered for a lesser amount but ordered the employer to put the injured worker back to work at a job that did not violate his restrictions


Admiralty / RADS

A tugboat captain was overcome by toxic fumes and developed Reactive Airway Disease Syndrome when a leak developed during the transfer of chemicals from a refinery to a ship. In a case filed in Galveston Federal Court, the firm successfully negotiated a successful settlement on behalf of the injured seaman.


Admiralty / Back Injury

An offshore oil worker injured his back when he was required to move heavy hoses with inadequate assistance or equipment. In a case filed in Galveston Federal Court, a successful recovery was negotiated.
